Waivers

Immigration imposes requirements on foreign nationals who are seeking to enter, stay or immigrate to the United States. There are the requirements one must meet to obtain the status – for example if you are looking to obtain a tourist visa you must show immigration your travel is temporary and you intend on returning to your home country. In addition, you are required to be admissible to the United States. Admissibility refers to a foreign national’s conduct. A foreign national must not do certain prohibited acts. If they have done them they are excluded from coming to the U.S. or, if in the United States, excluded from obtaining some/all immigration benefits or even deportable.

In these situations where a foreign national is considered inadmissible to the U.S., immigration lawyers can utilize waivers to dismiss the ground of inadmissibility, allowing the foreign national to remain legally in the U.S. There are several types of waivers, depending upon the type of conduct that made the foreign national inadmissible.

If you have questions about the waiver process or want to find out if filing a waiver is the right option for you, contact immigration attorney David M. Bercovitch right away.
